I would like to speak about the legal future of Cosplay and the ramifications of the Supreme Court decision on March 22, 2017 in the Athletica v. Varsity case which stated: “the artistic feature of the design of a useful article is eligible for copyright protection if that feature (1) can be perceived as a two or three dimensional work of art separate from the useful article and (2) would qualify as a protectable pictorial, graphic, or sculptural work either on its own or in some other medium if imagined separately from the useful article.” This case directly effects all Cosplayers. Ergo, some from of Cosplay is now copyrightable. I am a licensed IP lawyer in Houston and have been presenting on legal issues) and Dr. Who at Comicpalooza for over 3 years.
