General Rules and Guidelines for VENDORS AND ARTIST                                                                                                                                                                  

COMPLETING THIS APPLICATION IS NOT A GUARANTEE OF SPACE. PLACEMENT OF YOUR BOOTH AND/OR TABLE IS AT HCC AND/OR FIRE MARSHAL DISCRETION. PLEASE KEEP A FULL COPY OF YOUR AGREEMENT.                                                     

VENDOR QUALIFICATIONS HCC reserves the right to determine eligibility to participate in the Event and to restrict or remove any Vendor which HCC, in its sole discretion, believes is objectionable, inappropriate, or does not compliment and/or comply with HCC discretion. Vendors must register by legal business name with no authority to lease/sublease spaces—shared spaces allowed upon application/approval only. No adult materials may be displayed or sold without prior written permission of HCC.

SPACE ASSIGNMENTS Vending spaces must be open for business during the Event hours and will be assigned and/or reassigned by HCC at its sole discretion and in consideration of Fire Marshal Recommendation for safety and traffic whereas, in such an event, you may find your space moved per safety and traffic. Unused spaces are non-transferable and will be returned to HCC at its sole discretion. 

BOOTH SPACE LIMIT Height is not to exceed 10 feet and  stay within the designated 8' x 10' space provided.

NON-COMPLIANCE EJECTIONS ARE INELIGIBLE FOR REFUND AND NO REFUND SHALL BE ISSUED. THIS CONTRACT SHALL BECOME BINDING AND EFFECTIVE UPON CONTRACT SIGNED BY VENDOR AND COUNTER-SIGNED BY A DULY AUTHORIZED HCC REPRESENTATIVE. THIS HCC AGREEMENT IS BOUND BY AND SUBJECT TO TEXAS LAW.

VENDOR / HCC CANCELLATIONS

Vendor Cancellations greater than 30 days prior to opening day of Event will be refunded total due, less $75.00 and no refunds issued for cancellations made less than 30 days prior to opening Event day. HCC may terminate contract immediately (and Vendor’s participation in Event) without further notice or obligation to refund monies previously paid upon failure to make full payment required by this contract, additionally, Returned Checks and/or insufficient funds will incur a $25.00 processing fee. If HCC cancels the Event due to beyond reasonable controllable circumstances (such as acts of God (natural disaster), acts of war and/or terrorism, fire, government emergency, labor strike or unavailability of Exhibiting Facility) HCC shall refund each Vendor its rental payment previously paid, minus a share of costs/expenses incurred, in full satisfaction of Organizer's liabilities to Vendor in the event of said circumstances and does not include favorable weather.

ELECTRICITY Usage and pricing of Electricity is managed by facility, HCC will only acknowledge electricity requests through this agreement to ensure facility readiness.

CONTRIBUTING SPONSOR Unless participant wishes to remain an anonymous donor, Contributing Sponsorship requires vector logo, business information, and images (of product) to be used for promotional purposes (logo on merchandise and/or pamphlets, social media pages, and on dedicated items during Event).

COMPLETING THIS APPLICATION IS NOT A GUARANTEE OF SPACE. PLACEMENT OF YOUR BOOTH AND/OR TABLE IS AT HCC AND/OR FIRE-MARSHAL DISCRETION. PLEASE KEEP A FULL COPY OF YOUR AGREEMENT. 

Products & Services **Please attach a picture of your display with products AND Menu with all items and pricing for event; all items to be sold must be on this list. We will vet vendors in an attempt to create as little as possible competition (i.e., multiple pizza trucks). Please be advised alcohol is not permitted at this event. We are asking for a minimum of one item to reflect a comic/pop-culture theme for the event AND 7 vouchers per day for staff meals with no drinks. Please be aware, attendees will have the option to vote for best food truck at the event and participation in the event is participation on the voting ballot.

Permits/Insurance: Per New Braunfels municipal code, all food vendors are responsible to have necessary licensing, permits, and insurance to vend in New Braunfels and for the event itself in order to participate. This includes all municipal mandates for generators (for electricity), insurance, and Fire Extinguisher requirements as detailed by city ordinances. Failure to comply may result in municipal ejection or penalties with no refunds to the event; HCC is not responsible for vendor requirements and permits and is not responsible for any sanctions resulting in non-compliance. HCC will not supply generators. Placement of your Food Truck is at HCC's sole and absolute discretion and at Discretion of Fire Marshal and City Ordinances for public safety.
